Goods

For the purposes of these General Terms and Conditions (GTC), all products and their accessories, as well as spare parts for these products, which the Seller sells through its e-shop, are considered as “goods” or “items.”

The list of goods sold through the e-shop is the catalog of regularly supplied goods. Most of these goods are predominantly available in the Seller’s stock. The e-shop’s website allows checking the availability of goods at the individual Seller’s stores. Although the Seller aims to ensure that the e-shop’s website reflects the real-time availability of goods at individual stores, the Seller cannot exclude the possibility that certain items may be temporarily unavailable or sold out, and the information provided on the e-shop’s website may not be up-to-date. Therefore, if the Buyer has a special interest in having the goods delivered as soon as possible, the Seller recommends that the Buyer inquire about the availability of specific goods through the Seller’s contact details provided in Article 2.3 of these GTC. This will help the Buyer avoid situations where the goods are temporarily unavailable or sold out.

The description of the offered goods is provided on the e-shop’s website for each individual item. Any additional information related to the goods can be provided to the Buyer upon request. Maintenance and usage instructions for the goods are available to the Buyer in the Czech language on the e-shop’s website www.sneakersandaccessories.com in the “Maintenance Instructions” section, located here.

The subject of performance of the purchase agreement concluded between the Seller and the Buyer consists of individual items of goods that the Buyer included in their order as described in Article 6 of these GTC.

Communication from the Seller before concluding the purchase agreement

In accordance with § 1820 of Act No. 89/2012 Coll., the Civil Code, as amended (“Civil Code”), the Seller informs the Buyer that:

  • Information about the main characteristics of each offered item is provided for each offered item, within the scope corresponding to the means of distance communication used and the nature of the item or service.
  • The identification of the Seller, including its registered office, telephone contacts, and electronic mail delivery address, is provided in Article 2.3 of these GTC.
  • The list of Seller’s premises is provided in the list of stores accessible in the Online Stores section, which may change over time.
  • The prices of goods are stated on the e-shop as final prices, including all taxes and fees stipulated by law. However, the costs of delivering goods vary based on additional criteria (e.g., order amount, weight of goods, etc.), as further detailed in Article 11 of these GTC.
  • The Seller does not conclude contracts of indefinite duration or contracts for recurring performance. If such contracts were to be concluded and the price remains unchanged, the Seller will inform the Buyer of the price for one settlement period, which is one month.
  • The Seller does not adjust prices for individuals based on automated decision-making.
  • The costs of distance communication do not differ from the basic rate, and the Seller does not charge any additional fees.
  • The method of payment for goods is specified in Article 11 of these GTC. The method and time of delivery of goods are specified in Articles 9 and 11 of these GTC. The handling of Buyer complaints is managed by the Seller through the electronic address info@sneakersandaccessories.com The Seller will send information regarding the resolution of the Buyer’s complaint to the Buyer’s electronic address.
  • Conditions, time limits, and procedures for exercising the right to withdraw from the contract, as well as a model withdrawal form, are regulated in Article 13 of these GTC and Annex No. 2 to these GTC. In case of withdrawal from the contract, the Buyer shall bear the costs associated with the return of goods. If the nature of the goods prevents them from being returned by regular mail, the Buyer shall bear the increased costs associated with the return of goods. Goods can also be returned in person at any physical store of the Seller, the list of which is provided on www.sneakersandaccessories.com in the Stores section.
  • Rights arising from defective performance are governed by Article 12 of these GTC. The Seller does not provide after-sales service.
  • The Seller always acts in accordance with the law and these GTC during the sale, but has not adopted a specific code of conduct.
  • The Seller does not typically conclude contracts of indefinite duration or automatically renewing contracts. If such contracts are concluded, the Seller will always inform the Buyer in advance of the relevant parameters.
  • Information on the existence, method, and conditions of out-of-court settlement of consumer disputes, including information on whether it is possible to submit a complaint to a supervisory authority or state supervision authority, is contained in Article 16 of these GTC.

Conclusion of the Purchase Agreement

The Seller allows goods to be purchased through the e-shop for both customers who have created a customer account and customers who have not created a customer account and make one-time purchases. Customers with a customer account are recommended by the Seller to log in to their customer account using their email address and password before placing an order.

The Buyer expresses their interest in purchasing goods by clicking the “Add to Cart” button.

After the Buyer finishes selecting the goods they wish to purchase, they proceed to the shopping cart, where a summary of the goods added to the cart and their prices will be available. Information on whether free shipping applies to the specific purchase will also be provided.

Subsequently, the Buyer selects the method of delivery and payment according to Article 11 of these GTC. During this order step, the Buyer may apply a discount coupon (voucher).

If the Buyer is not logged into their customer account, they proceed to provide their personal information (email address, first name, last name, phone number, street, house number, city, state, postal code). The Buyer may also provide business information, such as identification number or tax identification number; however, if the Buyer does so, these GTC will not apply to them, and the Business Terms and Conditions of the online store www.sneakersandaccessories.com for entrepreneurs will apply instead.

Subsequently, the Buyer reviews the summary of their order, where they can check and adjust the content of their order if desired. The Buyer confirms, by creating the order, that they have familiarized themselves with these GTC (the Buyer checks the box labeled “I Agree to the Terms and Conditions”), including the Buyer’s pre-contractual communication contained in Article 5 of these GTC, information on personal data processing, delivery options, payment options, procedure for goods complaints, and expressly agrees to them in the wording valid and effective at the time of placing the order. If the Buyer agrees with the order in this form, they will confirm the order of the selected goods by clicking the “Submit Order and Proceed to Payment” button, which is binding for payment.

The binding confirmation of the order of goods through the e-shop by the Buyer constitutes a proposal for concluding a purchase agreement.

The purchase agreement is concluded when the Seller delivers an order confirmation to the Buyer in the form of an email message to the email address provided by the Buyer when placing the order. From this moment, mutual rights and obligations between the Seller and the Buyer arise, which are defined by the purchase agreement and these GTC, which form its integral

Rights and Obligations of the Contracting Parties

The Buyer is obligated to duly and promptly pay the agreed purchase price for the goods to the Seller.

The Seller is obligated to deliver the goods based on the Buyer’s confirmed order, in the agreed quantity, quality, and timeframe. The goods shall be properly packaged or dispatched for transportation in a manner necessary for their storage and protection. The Seller must ensure that the delivered goods comply with the valid legal regulations of the Czech Republic.

The Buyer has the right to receive the goods in the quantity, quality, timeframe, and location agreed upon by the contracting parties as indicated in the order confirmation.

The Buyer is obliged to accept the goods, pay the agreed purchase price within the agreed payment deadline, including costs incurred for the delivery of the goods. Depending on the chosen method of delivery, the Buyer must either confirm the receipt of the goods in writing with their signature or the signature of an authorized person. However, if the goods are collected at the Seller’s store, the Buyer shall provide the Seller with the order number and their identification details. If another person collects the goods on behalf of the Buyer, said person must present a written power of attorney from the Buyer and a valid official identification.

Purchase Price and Related Fees

The purchase prices of goods are based on the Seller’s catalog prices, currently issued and published on the e-shop’s website, valid at the time of the Buyer’s order submission.

Unless stated otherwise, the purchase prices are in Czech Crowns, including Value Added Tax (VAT) according to applicable legal regulations, and they are final for the Buyer.

The Seller reserves the right to change the purchase price if there is a significant change in the exchange rate of the Czech Crown against the Euro or the US Dollar, a significant increase in the consumer price index, or significant changes in supply conditions from manufacturers and other goods suppliers.

Potential discounts on goods cannot be combined unless expressly stated otherwise on the Seller’s website.

Delivery of the goods is conditional upon payment of the purchase price. The Buyer is required to pay the full purchase price as specified in Article 11 of these Terms and Conditions. If the Buyer does not choose the option of personal pickup, they are obliged to pay the purchase price of the delivered goods, including transportation costs, before taking possession of the goods.

If the Buyer chooses a payment method associated with special payment fees, they commit to pay these special payment fees in addition to the purchase price, as specified in the purchase agreement. The Buyer will receive a tax document in printed or electronic form for each item.

Promotional prices are valid until the Seller’s stocks are depleted or until the specified quantity of promotional goods is sold, whichever comes first.

Delivery Conditions

Proper and timely delivery of goods is considered:

The Buyer’s acceptance of the goods. Enabling the Buyer to take possession of the goods at the designated delivery location. If the ordered goods are in the Seller’s warehouse, they will typically be sent to the Buyer or handed over to a carrier within four (4) business days from the date of concluding the purchase agreement.

If the Seller and the Buyer do not agree otherwise, the Seller must process the Buyer’s order within 14 days from its receipt via the e-shop. Processing the order means delivering the goods properly and on time in accordance with Article 9.1 of these Terms and Conditions.

In the case of the Seller delivering goods through a mail service, the Buyer acknowledges that it’s usually not possible to specify the exact time of delivery in advance.

Orders comprising multiple items may be dispatched to the Buyer from different branches of the Seller, and therefore sent independently. However, in such cases, transportation costs for the Buyer remain unchanged.

Circumstances that exclude the Seller’s liability for delayed delivery include force majeure, war, epidemics, pandemics, operational disruptions, exceeding delivery deadlines by the Seller’s suppliers, shortage of materials, energy, or labor, strikes, work stoppages, transportation sector issues, transport disruptions, public regulations, as well as all similar circumstances or circumstances presumed by law. If such a circumstance arises, the Seller will deliver the goods to the Buyer without undue delay once the aforementioned obstacle is removed.
